Right to Manage

Right to Manage

What is Right to Manage?
In accordance with the United Kingdom Commonhold and Leasehold Reform Act 2002, Right to Manage provides, in basic terms, a means for lessees to regain control of the management of a site or block from the freeholder-appointed managing agent.

To begin the Right to Manage process, a set of specific criteria must firstly be met, and a minimum number of lessees must wish to participate. Once these criteria have been satisfied, lessees set up a limited company, to which responsibility for the management of a site or block can be transferred. This company  may then choose to appoint an alternative managing agent, without having to prove that the site or block was being managed inadequately by the previous managing agent.

The Benefits:

  • Lessees can choose to appoint a new managing agent and improve previously poor standards
  • Lessees can give voice to how they would like their site or block managed
  • Lessees may, on occasion, find that savings in expenditure can be made through better budget management and improved planning strategies.

Switch to Encore
Encore is well positioned to advise on the required criteria and legality in each individual case, as well as able to support lessees throughout the Right to Manage process. So if you're unhappy with your current managing agent, consider Right to Manage as a means to switching to Encore.
